Contract Terms and Conditions for Bellhire Flexible Contracts

·          Ordering a vehicle: The Customer will be required, in all cases, to sign an order confirmation for all rentals. Rentals can be charged to a person corporate or private subject to status. Orders are made by car group and are subject to availability. Bellhire may supply an alternative model to those listed. Whilst Bellhire will make every effort to provide the vehicle on the requested date delivery dates cannot be guaranteed. The vehicle must be accepted within 3 days of it being made available to the hirer by Bellhire and charges will commence at midnight of the 3rd day or on the day of delivery, whichever is the sooner.

 

·          Delivery: The vehicle will be delivered and collected by Bellhire plc. Prior to return the vehicle(s) be inspected by an independent inspector, this will be done by appointment with you within 5 days of the end of contract, or the day you make the vehicle available to us, should the interior of the vehicle be excessively dirty, a valeting charge will be incurred Delivery and inspection will be calculated in accordance with the published tariff and will be added to the rental amount and spread over the duration of the rental.  It is the responsibility of the Hirer or their agent to inspect the vehicle upon delivery and agree the condition of the vehicle with Bellhire.

 

·          Deposit: Each Rental will be subject to a deposit equivalent to a minimum of one calendar months rental. Following delivery of the vehicle and payment of the rental due under the Rental Agreement, the Deposit will be held by Bellhire as its absolute property until the Agreement is terminated and all liabilities of the hirer therein have been discharged to the entire satisfaction of Bellhire.

 

·          Vehicle Exchange: Bellhire may, given reasonable notice to the hirer, at any time during the rental period, exchange the vehicle for an alternative of comparable class and mileage, the expense of delivering and collection of such an exchange shall be borne by Bellhire, such vehicle exchange will be at the convenience of both the end-user and Bellhire but within 10 days of any request by Bellhire.

 

·          Mileage Allowances: Mileage allowances and excess charges shall be calculated on each vehicle, pro rated for the actual period each individual vehicle is with the hirer and shall not be amalgamated or pooled.

 

·          Ancillary Charges: Should any ancillary charge arise under the Agreement, Bellhire shall, following termination thereof, first apply the Deposit in satisfaction of those charges.  Any balances due to the Hirer shall be reimbursed to the Hirer in full within twenty-eight days of the date of termination, any balance due from the hirer will be taken by direct debit and is payable not later than 28 days from the date of termination. Ancillary charges may include, but are not limited to, excess rental days, excess mileage, vehicle repairs, early termination, servicing costs, late payment fees and fuel as well as delivery and collection charges. Any

 

·          Rental Periods and Termination: Each agreement will be split into rental periods of not more than 1 calendar month. The agreement may be terminated by either party at any time given one calendar month's notice, given only that the vehicle must be in a fully roadworthy condition and cannot be terminated whilst undergoing repair either mechanical or bodywork, or in an unroadworthy condition.

 

·          Rates: The rates charged are for the period specified in the order confirmation. In the event of earlier termination of the agreement, by either party, the Hirer will be responsible for payment of the hire and ancillary charges, for the actual period of rental, in accordance with the charges schedule as published on the website at the time of the order, subject to the satisfaction of the notice period, except that if Bellhire require the early termination through no breach by the hirer, the rental rates, shall be calculated, pro rata, as if the rental had continued for the period specified in the agreement. Mileage allowances and therefore excess mileage will be calculated based upon the actual period of rental for each individual vehicle.

 

·          Payment / Invoicing: Vehicles are supplied on a non credit basis. Payment must be received by the monthly anniversary of the day of delivery (the due date}. Payment shall be made on a monthly basis, by direct debit. Hirers will also be required to provide a valid credit card, if monthly payments are made by credit or debit card they will attract a card payment fee of 2.5% (5% for American Express).

 

·          Insurance: The hirer may opt for a rental rate inclusive of insurance subject to conditions and Excess, if the hirer opts for this, Bellhire will require the completion of an individual drivers proposal for each driver and a copy of each driving licence. Or the Hirer may provide comprehensive insurance for any vehicle hired from Bellhire and must complete an insurance Indemnity Form. Bellhire must hold a copy of the Hirers current insurance certificate on file. If these insurance details alter in anyway, Bellhire must be notified immediately. It is the responsibility of the hirer to keep insurance valid and up to date at all times, this includes updating your insurance policy if an exchange or additional vehicle is supplied.

 

·          Drivers Licences: It is a legal requirement that Bellhire must register valid driving Licence details on the rental agreement upon delivery of a vehicle. Where a vehicle is covered by customers own insurance, it is not necessary to view each individual hirers driving Licence. However, to comply with the Law details of a valid Licence must be entered on the rental agreement.

 

·          Accidental Damage:  Any damage is to be reported to Bellhire within 4 working hours, whether covered by Bellhire Insurance or the customers own. The vehicle will remain on rent to The Lessee until it is repaired and in a rentable condition. Bellhire will always assist the hirer in repairing a vehicle as quickly as possible, and at a competitive price. If you are insuring the vehicle, any charge / invoice relating to an accident such as recovery charges, road repairs etc. will be invoiced to the hirer and will be payable within 7 days. The Hirer is responsible for reclaiming any insured losses.

 

·          Breakdowns! Accident: All Bellhire vehicles are covered by the relevant manufacturers assistance service. Should a breakdown or accident occur the driver should contact the relevant service immediately. Upon inspection of a breakdown.

 

·          Vehicle Maintenance: Whilst a vehicle is on rent it is the responsibility of the Hirer to ensure all levels, as instructed by the vehicle handbook, are checked regularly and replenished to recommended levels when necessary. The costs of these items are the responsibility of the Hirer. The Hirer must also ensure that both tyre condition and pressure, are checked regularly. It is the responsibility of the hirer to repair or replace windscreen / glass damage and keep the vehicle in good condition at all times. Should any fault occur in the running of the vehicle, it is the responsibility of the Lessee to notify Bellhire immediately to prevent further damage. Because the Manufacturers have Increased their servicing Intervals your vehicle will not normally need any Franchised Servicing, you have the option of including servicing, in the rate, at the beginning of the rental if you believe it may be required.

 

·          Mileage: You will need to select the mileage allowance at the start of your hire. Either 2,000 or 3,000 miles per Rental Period, excess mileage will be chargeable after every vehicle exchange and vehicle off-hire. Excess miles will be calculated by multiplying the days of hire (from first day of hire to date of exchange or off-hire) by the relevant mileage allowance. Bellhire must be notified once the vehicle odometer has covered 11,000 miles. If the vehicle is driven in excess of 12,000 miles on the odometer without the prior written consent of Bellhire. excess mileage will be charged at a minimum of £0.50 per mile.

 

·          Parking Charges / Fines: Any Parking Tickets, Speeding Fines, Congestion Charges & Bus Lane Offence Fines incurred during the rental period will be the responsibility of the Hirer, any such charges will be billed together with an administration fee of £25.00 + VAT. The hirer is responsible for any parking charges and fines or towing fees incurred once the vehicle is delivered and until collected by a representative of Bellhire. Any vehicles left in a car park and not returned to an agreed location will be subject to collection, towing and or parking charges.
